NBU intends to explore the views of bankers on whether to initiate a ban on early withdrawal of deposits

The National Bank had previously said the possible development of legislative initiatives regarding the prohibition on early withdrawal of term deposits, is going before making a final decision on this matter to explore the views of bankers and depositors. This is stated in the message NBU. "Decisions in such sensitive matters as the rights and responsibilities of investors, may be taken only after extensive discussion and if there is support for appropriate action by all concerned social groups. Only after finding a mutually acceptable mechanisms to address this issue, the NBU will be tried and tested to make proposals to the Verkhovna Rada "- the report says. National Bank stresses that the previously released their proposals on the possibility of a ban on early withdrawal of time deposits are not the final position of the National Bank, and an invitation to debate on this issue. Regulator expresses concern at the possibility of the banking system, serious problems due to massive withdrawals of deposits in certain depositors of crisis. In this context, National Bank emphasizes that he considers the task of initiating these changes in legislation that would have eliminated the possibility of asymmetry in rights and obligations of banks and their customers. As reported, in early February, the NBU said the possible development of legislative initiatives regarding the prohibition on early withdrawal of time deposits. Along with this initiative NBU also consider the second alternative solution to the problem of early withdrawal of term deposits, investors: the establishment of a 30-day period during which the bank should issue term deposit to the depositor. Appropriate changes (on the first or second option) NBU intends to offer the Verkhovna Rada to amend article 1060 of the Civil Code. Proposals on this issue NBU takes up to 20 February. The current wording of article 1060 of the Civil Code provides that the contract of bank deposit, regardless of its form (time deposit or demand) the bank must give all or part of it upon request of a depositor.
