European Commission for Democracy through Law (Venice Commission) believes that the composition of the Constituent Assembly shall determine the Verkhovna Rada. This is stated in the Commission's decision on a review of the establishment and activities of the Constituent Assembly. According to experts, the declared principle of formation of the Assembly suggests the intention to ensure broad representation in the national political forces, NGOs and expert constitutionalists. At the same time, the Commission is concerned about the principles of their selection. "While in other countries, members of constituent assembly chosen by popular vote or indirectly in the parliament, it is arguable that members of the Constituent Assembly will be appointed by the President," - said in the decision. According to the commission, members of the Assembly shall be appointed Rada, which will provide a political compromise and a wider representation in the Assembly. Commission experts believe that the leading role of the President in the constitutional process may indicate the presence of political will in carrying out this reform and be decisive in its support of politicians. However, they caution that it is important to avoid a disproportionately large influence on the President of the reform process. The Venice Commission stresses that the Assembly would ensure participation in the constitutional reform of all major political forces and public organizations, as well as to initiate public discussion of reform. Experts note that to achieve a successful result, the Assembly must be independent enough. We recall that on 21 February, President Viktor Yanukovych signed a decree on the Work of the Expert Group on the establishment of the Constituent Assembly and held the first meeting of that body. The structure of scientific expert group consisted of 20 scientists and experts on constitutional law. The Assembly should turn out proposals for amending the Constitution of Ukraine.
